Global Security and Aerospace Firm Named in New Employment Discrimination Lawsuit

In early July, a San Francisco-area woman filed an employment discrimination suit against her former employer, a global aerospace and security company, alleging that her termination was due to her age.

According to the lawsuit, the plaintiff’s former employer informed her of the layoff in 2015, allegedly explaining it as a move that was necessary due to cutbacks in funding.

However, shortly after being laid off, the plaintiff learned that her role had not been eliminated at the company, and instead, a much younger employee had been hired to fill the position.  Upon learning she was not terminated due to funding cuts, the plaintiff filed a lawsuit alleging age discrimination and wrongful termination.

Employment Discrimination Cases

Discrimination, or any behavior that results in the unequal or unjust treatment of an individual based on certain personal characteristics or qualities, continues to be a key issue in the workplace today.

Discrimination in the workplace continues to be strictly prohibited by both state and federal laws.  According to these laws, unlawful discrimination occurs when an employer fires, refuses to hire, demotes or otherwise unjustly treats an employee due to individual characteristics, which can include:

  • Age
  • Sex
  • Race
  • Medical condition
  • Disability

For example, it is illegal for any employer to discriminate against an employee based on their age, as California state law protects employees over the age of 40 from being treated unfairly or forced out of a position due to their age.  While many organizations have policies and procedures designed to prevent discrimination in the workplace, employees are often provided with subjective reasons for termination or layoff when the real reason is based on the age of an employee.
